EVENT @10AM |  MIDTERM ELECTIONS AND THE BIDEN TECH AGENDA - DEMREP

The upcoming midterm elections could shift control of both the House and the Senate, changing leadership priorities and affecting the appointment and confirmation of regulators to the Federal Trade Commission (FTC) and the Federal Communications Commission (FCC).  The outcome, particularly in the Senate, could also affect the pace of judicial confirmations as the White House hopes the appointment of progressive judges will gradually shift the legal climate in favor of an aggressive agenda.  We'll focus on:

  • Prospects for continuing efforts to pass antitrust legislation targeting dominant tech platforms;
  • Bipartisan interest in legislation to curtail the tech platform liability shield (Section 230 of the Communications Decency Act);
  • Confirmation of an FCC majority with a renewed net neutrality agenda;
  • Potential FTC administrative proceedings to block Amazon and Meta (Facebook) acquisitions.
