Ayr Wellness Moves to Definitive Agreement to Acquire Garden State Dispensary (New Jersey). According to the Purchase Agreement, Ayr will purchase 100% of the equity interests of GSD, one of the 12 existing vertical license holders in the State of New Jersey, and one of the state’s original six alternative treatment centers (ATCs). GSD has three open dispensaries, the largest retail footprint of any operator, at heavily trafficked highway locations throughout the central region of the state, and a 30,000 sq. ft. facility that houses the existing cultivation and production facilities in operation. An additional 75,000 sq. ft. is currently under construction. GSD currently employs 110 people, all of whom are expected to be retained by Ayr.

South Dakota is ready.

The Republican Party generally dominates South Dakota politics, and the state has not supported a Democratic presidential candidate since 1964, so getting medical Cannabis is big news.  Gov. Kristi Noem has tried to delay implementing a medical marijuana program; a legislative leader on marijuana issues believes the state can be ready to roll out its first prescriptions for the legal pot by Nov. 18, 2021, as scheduled.  Noem said the state needed more time to enact a well-designed regulatory framework, but her bill to put off the July 1, 2021 implementation date by a year failed in the Legislature.  The medical marijuana program, created by Initiated Measure 26, was approved by nearly 70% of voters in November 2020. IM 26 requires creating a regulatory framework by the Department of Health within 120 days of its taking effect, or by Oct. 29, 2021, and issuance of the first medical marijuana prescription cards to patients within 140 days, or by Nov. 18, 2021.  With the passage of IM 26 taking place on Nov. 3, 2020, South Dakota will have had slightly more than a year to prepare for the issuance of the first prescriptions for medical marijuana. North Dakota recently took nearly two years to implement its medical marijuana program, while Minnesota took about 13 months to start its program.

No THC Caps in FL

Florida Gov. Ron DeSantis said on Monday that he opposes a House plan to cap the THC amount in medical cannabis, likely dooming the measure for the third consecutive legislative session.  The House bill, FL HB1455 (21R), would limit raw, “flower” medical marijuana to a THC concentration of 10%. Products such as concentrates and oils would be limited to 60% THC. According to Politico, speaking to reporters at the state Capitol, DeSantis said he had already told House Speaker Chris Sprowls (R-Palm Harbor) that he will not sign the bill.
